Boundary Agreements
Where adjoining owners agree to a new boundary alignment it is a good idea to formalise such an agreement in writing. A legal adviser can draft a suitable ‘boundary agreement’ that can be noted on the individual registers. Alternatively, owners can appoint a Chartered Land Surveyor to ‘determine’ the exact line of the agreed boundary and have it recorded on the register in accordance with Section 60 of the Land Registration Act 2002. The survey plan of the relevant boundary and properties would be submitted with the application form and endorsed with a Certificate of Accuracy certifying that the measurements shown on the plan had a relative accuracy of +/-10mm.
